Right of recall for surplus teachers |
Surplus
Being declared surplus means that while there isn't a position available at your school for next year, there is a position elsewhere in the board. Surplus teachers have access to the transfer rounds of postings to apply for a new position for next year. Any surplus teacher that does not secure a new position in the transfer rounds will be placed at a school by June 6.
Surplus is determined based on the order of least seniority in your school. Seniority is measured as continuous time as a permanent teacher in Durham. There are tie-breakers that rely on other previous teaching experience and other factors in the event that there are teachers with the same seniority as other permanent teachers.
Right of Recall
A surplus teacher that arranges a placement through the transfer rounds or is placed, maintains a right of recall to their home school until the end of June. Any position that opens up at the home school is offered to teachers on the recall list in the order of greatest seniority.
Teachers not declared surplus but looking to arrange a placement at another school can apply through the transfer rounds as well.
Transfer of Schools
The transfer rounds 1, 2, and 3 are open to current permanent teachers of the Board with round 3.1 being open as well to eligible Con-Ed Article 10 teachers. An eligible Article L10.00 Adult Day School Teacher is defined as a teacher that has taught two (2) courses over at least one (1) term in the previous twelve (12) months.
Part-time teachers can only apply to 0.5 positions in rounds 1, 2, and 3 to transfer schools. In round 3.1, part-time teachers are able to apply to 0.5 positions to elevate to full time, or apply to 1.0 positions.
Displacement/Redundancy
In the case where there are more surplus teachers than there are positions, displacement/redundancy may occur. This means that any remaining surplus teachers that are unassigned at the end of the surplus placement process can be placed into positions that displace teachers with less regional (boardwide) seniority. Teachers at risk of displacement/redundancy are those with the lowest seniority across the board - not just their home school.
We have not had a recent displacement/redundancy situation in Durham and the process will be new to those that are familiar only with the surplus process. Whereas surplus declaration takes place on April 4, displacement is declared by May 31. Teachers at schools that did not have any surplus may still be notified of being displaced/redundant by May 31 if they have less seniority than a surplus teacher at another school.
A teacher that is displaced/redundant will have right of recall to any position that opens up in the Board. With any growth in enrolment, retirements, or leaves of absence, jobs that become available are given to displaced/redundant teachers. Placement of displaced/redundant teachers takes priority over hiring new teachers to the board. Any teachers that are displaced/redundant can anticipate that they will return to a regular permanent position with time.
